In compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (“LSSICE“), Perk Finance, S.L. (“Perk Finance“) informs that it is the owner of the website www.cobee.io. In accordance with the requirement of Article 10 of the aforementioned Law, PERK FINANCE provides the following information:

The owner of this website is PERK FINANCE, S.L., a Spanish company with registered office in Madrid, at C/Francisco de Rojas 5 – Esc. Dcha. 1 – 3 – 28010, and registered in the Companies House of Madrid, with Tax Identification Number (NIF) B-88.243.233. The contact email address with the company is privacy@cobee.io.

This document (the “Terms and conditions of use“) aims to establish and regulate the rules of use (including access) of the web pages that are part of the site www.cobee.io, including the content, data, and information made available on them. The term “Website” refers to all pages and their contents accessed through the domain www.cobee.io.

2. User and Responsibility Regime

The access to the website www.cobee.io attributes to the person who performs it the status of a user (the “User“), expressing full and unconditional acceptance by the User of each and every one of the provisions contained in these Terms of Use. Therefore, it is understood that anyone who accesses this site agrees to comply with it.

Certain contents of the Website may involve online contracting, and since certain services are exclusive to registered users (the “Registered Users“), their access is restricted and subject to the General Terms and Conditions of the PERK FINANCE Service.

In any case, PERK FINANCE reserves the right to modify, expand, or temporarily suspend, unilaterally and without prior notice, the presentation, technical specifications and configuration of the Website and its contents and services, as well as these Terms of Use or the corresponding General Conditions of Service Contracting.

PERK FINANCE does not guarantee: (i) the availability, continuity, absence of deficiencies and security of the Website, (ii) that the content of the Website or the information that passes through it is free of viruses or other harmful elements, as well as errors, omissions, or inaccuracies, (iii) privacy and security in the user’s use of the Website. Consequently, the User assumes any risks that may arise from the use of the Website.

The Website provides a variety of information and data. The User assumes responsibility for the correct use of the Website. This responsibility will extend to:

  • The truthfulness and legality of the information provided by the User in the forms provided for access to certain content or services offered through the Website.
  • The use of information, services and data contrary to the provisions of these conditions, the Law, morality, good customs, or public order, or that may in any other way harm the rights of third parties or the proper functioning of the Website.

3. Intellectual and Industrial Property

Trademarks, designs, texts, images, illustrations, photographs, and other content found on the Website, as well as any other intellectual creations and/or inventions, are the property of PERK FINANCE or third parties.

The User may not use the content without the express written consent of PERK FINANCE or its legitimate owner, obtaining only authorization to view the content through browsing the Website.

Reproduction, distribution, public communication, transformation, availability, or the establishment of links to the PERK FINANCE page from another page or website, or any other form of exploitation of the content without the prior written authorization of PERK FINANCE or its legitimate owner is not allowed.

In the event that any User or third party considers that any of the contents on the Website constitutes an infringement of intellectual property protection rights or is in any way unlawful, harmful to the rights or interests of third parties, or contrary to public order or good customs, they may notify PERK FINANCE at the email address privacy@cobee.io.

4. Terms of use

The User undertakes to make proper use of the Website in accordance with the Law and these Terms of Use. The User will be responsible to PERK FINANCE or third parties for any damages and losses that may arise as a result of the breach of this obligation.

The use of the Website for purposes harmful to the property or interests of PERK FINANCE or third parties, or in any way overloading, damaging, or disabling the networks, servers, and other computer equipment (hardware) or products and computer applications (software) of PERK FINANCE or third parties is expressly prohibited.

PERK FINANCE reserves the right to prevent or prohibit access to the Website to any Internet user who introduces any illicit content, violates the rights or interests of third parties, or is contrary to these Terms of Use or current legislation, reserving the right to exercise the legal measures it deems appropriate to prevent such conduct. The User agrees, therefore, not to use the Website unlawfully, harmful to the rights or interests of third parties, or in any way contrary to these Terms of Use or current legislation.

All information provided by the User to PERK FINANCE through the website forms or any other means must be truthful. For these purposes, the User guarantees the authenticity of all the data communicated and will keep the information provided to PERK FINANCE perfectly updated so that it responds, at all times, to the real situation of the User. In any case, the User will be solely responsible for false or inaccurate statements made and for the damages caused to PERK FINANCE or third parties by the information provided.

5. Exclusion of Liability

PERK FINANCE will not be liable for:

(i) Possible damages or losses that may arise from interferences, omissions, interruptions, computer viruses, telephone breakdowns, disconnections in the operational functioning of the Website, delays, or blocks in the functioning of the Website, or intrusions by third parties on the Website.

(ii) Damages of any kind suffered by the User resulting from failures or disconnections in telecommunications networks that cause the suspension, cancellation, or interruption of the Website service at any time.

(iii) Those contents, commercial activities, products, and services included that may be viewed through electronic links (links), for purely informative purposes, if any. These links do not represent any type of relationship between PERK FINANCE and the companies or individuals who own the websites that can be accessed through these links. PERK FINANCE reserves the right to withdraw the links that may appear at any time and without prior notice.

(iv) Consequences that may arise from errors in the content that may appear on this Website, although PERK FINANCE states that it makes its best efforts to avoid any errors in such content. It is also not responsible or guarantees that the content or software that can be accessed through this Website is free of errors.

(v) Losses, damages, or any kind of harm that may arise from access and use of the Website.

It is the User’s responsibility, in any case, to have adequate tools for the detection and disinfection of harmful computer programs. Access to the Website requires services and supplies from third parties, including transportation through telecommunications networks whose reliability, quality, continuity, and operation do not correspond to PERK FINANCE.

6. Communications via Email

The information contained in emails and/or attached file(s) sent from any email address of the @cobee.io domain is confidential and privileged and is intended to be read only by the recipients to whom it is addressed. This information is also the property of the sender, and its disclosure, copying, or distribution to third parties without the prior written authorization of the sender is prohibited.

If you receive an email and are not the designated recipient, the employee, or the agent responsible for delivering the message to the recipient, or if you receive an email by mistake, you must immediately notify it, return the email and/or its attached document(s) to the sender’s address, and proceed to destroy them.

Personal data derived from communications via email will be incorporated into the processing system of PERK FINANCE.

7. Jurisdiction and Venue

PERK FINANCE also reserves the right to file civil or criminal actions it deems appropriate for the misuse of its Website and content or for the breach of these Terms of Use of the Website.

The relationship between the User and PERK FINANCE will be governed by the current and applicable regulations in Spanish territory. If any dispute arises regarding the interpretation, compliance, or execution of these Terms of Use or applicable regulations, the parties expressly agree to submit to the jurisdiction of the competent Judges and Courts of Madrid Capital, unless the applicable regulations on jurisdiction and competence establish a different jurisdiction in this regard.
